1. Purpose
These terms and conditions of sale apply to any order placed on popelote.com by a consumer. Placing an order means accepting the terms in force on the date of the order.
2. Seller

Address: 129 chemin de Roumagoua, 13600 La Ciotat, France.

3. Products
Popelote sells crochet kits to make a little character yourself (amigurumi). Each kit contains the yarn for the model, a crochet hook, accessories (safety eyes, stuffing, markers, needle) and a QR card giving access to the step-by-step video. The exact contents are listed on each product page.
Photos show the finished character and the kit contents. The final result depends on your work, and colours may vary slightly between screens and yarn batches.
Kits are intended for adults and teenagers. The finished character contains small parts: do not give it to a child under 3.
4. Prices
Prices are shown in euros, all taxes included. VAT not applicable, article 293 B of the French General Tax Code. Shipping costs are shown before you confirm your order.
As kits are shipped from China, import taxes may apply depending on your delivery country. If you have any questions about this, contact us before ordering.
The bundle price (2 kits for €49, 3 kits for €69) applies automatically in the cart, whichever kits you choose. It cannot be combined with other offers unless stated otherwise.
The price charged is the one displayed at the time of ordering.
5. Orders
You choose your kits, check your cart, enter your details and delivery method, then confirm payment. The order is final once paid. A confirmation email summarises your order.
We may refuse or cancel an order in the event of an existing dispute with the customer, obviously incorrect information or suspected fraud. Any amount paid is then refunded.
6. Delivery
We deliver to the countries of the European Union. Kits are shipped directly by our manufacturer, from China. The delivery time is 7 to 10 days from the order; estimated delivery dates are shown on the product page and in the cart, before payment. Every parcel is tracked: you receive the tracking number by email as soon as it ships.
Shipping costs €4.90 for 1 kit and is free from 2 kits. Details are on our shipping and returns page.
If delivery does not take place within the stated time, you can ask us to deliver within a reasonable additional period; failing that, you can cancel the order and receive a full refund within 14 days (articles L216-2 and L216-3 of the French Consumer Code).
The risk of loss or damage passes to you when you (or the person you designate) take physical possession of the parcel. If a parcel is damaged or incomplete, write to contact@popelote.com with a photo.
7. Payment
Payment is made online when you order, by card (Visa, Mastercard, American Express, Cartes Bancaires), Apple Pay, PayPal, Shop Pay or Klarna. Payments are processed by Shopify Payments and its partners; we never have access to your bank details.
8. Right of withdrawal
You have 14 days from receipt of your order to withdraw, without giving any reason (article L221-18 of the French Consumer Code).
To do so, send us a clear statement (for example an email to contact@popelote.com) or the form below. Then send the products back no later than 14 days after informing us of your decision, to: Popelote — Retours, 526 rue Paradis, 13008 Marseille, France. Return shipping costs are paid by you.
We refund all amounts paid, including the original shipping costs (based on the standard rate), within 14 days of your request. We may withhold the refund until we receive the products or proof that they have been sent. The refund is made using the same payment method as the order.
You may open the kit to check its contents. However, if the yarn has been used or the kit has been handled beyond what is necessary to establish its nature and contents, an amount corresponding to this loss of value may be deducted from the refund (article L221-23).

9. Legal guarantees
All kits are covered by the legal guarantee of conformity (articles L217-3 and following of the French Consumer Code) and the guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code).
- The consumer has two years from delivery of the goods to invoke the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only needs to establish that the lack of conformity exists, not when it appeared.
- The legal guarantee of conformity includes the obligation to provide any updates needed to keep the goods in conformity.
- It entitles the consumer to repair or replacement of the goods within thirty days of the request, free of charge and without major inconvenience.
- If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.
- If the consumer requests repair but the seller imposes replacement, the legal guarantee of conformity is renewed for two years from the date of replacement.
- The consumer may obtain a price reduction while keeping the goods, or terminate the contract and receive a full refund against return of the goods, if the seller refuses to repair or replace them, if repair or replacement takes more than thirty days, if it causes major inconvenience, or if the lack of conformity persists.
- The consumer is also entitled to a price reduction or termination of the contract when the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer then does not have to request repair or replacement first.
- The consumer is not entitled to terminate the sale if the lack of conformity is minor.
- Any period during which the goods are immobilised for repair or replacement suspends the remaining guarantee period until the goods are returned in working order.
- The seller may be fined up to €300,000, which may be increased to 10% of average annual turnover (article L241-5 of the French Consumer Code), for acting in bad faith to obstruct the legal guarantee of conformity.
- The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.
For any request, write to contact@popelote.com with your order number and a photo.

12. Governing law and disputes
If you have a problem, please contact us in writing first so we can find an amicable solution.
These terms are governed by French law. If you live in another European Union country, you also benefit from the mandatory provisions of the law of your country of residence. Failing an amicable agreement, the competent courts are those designated by law.
